§ 1 Validity of the Terms and Conditions
(1) Terminal Apartments is the operator of the website with the URL https://www.terminal-apartments.de. On this presentation platform Terminal Apartments offers the possibility to rent apartments. The following General Terms and Conditions (GTC) apply to all services offered by Terminal Apartments. Terminal Apartments does not recognize any other GTCs.
(2) Terms and conditions of the guest shall only apply if they have been agreed upon in advance. Deviations from these terms and conditions are only effective if the owner listed in the imprint has expressly confirmed them in writing.
§ 2 Booking/booking confirmation
Booking requests can be sent to us as follows via booking directly on this website in writing to info@terminal-apartments.de by telephone (number in the imprint) via WhatsApp (number in the imprint). There is no guarantee if other booking requests than the written ones can be granted.
§ 3 Conclusion of Contract
(1) The booking request of a Guest shall be addressed directly to Terminal Apartments. Also possible further communication takes place exclusively between Terminal Apartments and the Guest or between the Guest and the Host. The Guest books his accommodation directly on the homepage of www.terminal-apartments.de. By booking, the Guest accepts the prices and all other conditions, such as the General Terms and Conditions. With the payment and booking the accommodation contract between guest and host is concluded.
(2) The payment of the final price takes place - depending on the selection of the guest - in advance through various online payment tools. In any case, the booking must be paid BEFORE departure. In the case of a cash payment on site takes place only in extremely rare cases and can only be guaranteed upon explicit request.
(3)Default of payment: Unless otherwise stated in writing, the default of payment applies in case of non-payment of the full amount from the 1st day of booking. The first reminder in the amount of 10,00 € + booking amount will be sent 7 days after the start of the trip/1st day of booking. The second reminder in the amount of 10,00 € (+ 10,00€ first reminder + booking amount) takes place 14 days after the start of the trip. The third reminder in the amount of 10,00 € (+ 10,00€ first reminder + 10,00€ second reminder + booking amount) takes place 21 days after the start of the journey. From the 28th day in case of non-payment after the start of the trip, the claim will be handed over to a collection agency. All costs incurred within the scope of the collection + reminder fees are to be borne by the customer/guest.
(4) The apartment may be entered by the persons listed in the booking. Should the apartment be used by more persons than agreed, a fee of 25€/person/night is to be paid for them and must be communicated BEFORE departure. In case of violations, 100€ (net) per day will be charged per unregistered person.
(5) Changes to a booking or subsequent booking are possible, if applicable, as long as they are made BEFORE the day of arrival.
(6) The subletting or subletting of the provided apartment as well as its use for other than residential purposes is prohibited.
§ 4 Arrival and departure
(1) On the day of arrival the apartment is available from 16:00. The handover of the keys takes place contactless (a detailed description of the access to the apartment is included in the booking confirmation). Claims for damages cannot be asserted if the apartment can exceptionally not be occupied punctually at 16:00. On the day of departure, the apartment must be vacated by 10:00 am. The landlord reserves the right to charge for a late departure.
(2) An early check-in, or late check-out, is possible upon request with an extra charge of 10€ per hour, depending on availability. An early-check-in before 12pm or a late check-out is charged at 75€ as we need to close the night before or after as well.
§ 5 Condition of the apartment
(1) The apartment will be handed over by Terminal Apartments in a tidy and clean condition with complete inventory. If there are any deficiencies, they have to be reported to the host directly after check-in. The host must also be informed immediately of any damage that occurs during the rental period. The guest is liable for any damage caused by him to the rental property, the inventory, e.g. damage to the floor or furniture. The inventory is to be treated carefully and with care and is only intended to remain in the apartment. The tenant is also liable for the fault of his fellow travelers.
(2) The moving of furniture, especially beds, is prohibited.
§ 6 Pets
The possibility of accommodating pets of any kind varies according to the apartment and can be read in the description, if necessary asked. The accommodation of these will be allowed only with the prior written consent of Terminal Apartments.For the accommodation of dogs, the provider charges an additional fee, which can be found in the house rules. If animals are brought without the prior consent of the host, a violation fee of 75€/night/pet will be charged. Dogs must be house-trained, must not be left unattended in the apartment and are not allowed on the bed or sofa. A basket for the dog will be provided. A deposit of €100 must be paid before arrival. This will be refunded once the apartment has been returned in good condition - without urine stains, without excessive pet hair on the sofa and without any droppings in the garden.
§ 7 Stay
The apartment may be used only in the booked period.
§ 8 Cancellations
(1) Cancellation by the guest must be made in writing. If this is not done, the agreed price must be paid even if the guest does not use the contractual service.
(2) In the event of cancellation of a booking, the following cancellation costs will be incurred in relation to the respective final price of the booking: Full refund for cancellations if the check-in date is still at least 15 days in the future. 50% refund for cancellations made at least seven days prior to departure. No refunds for cancellations made within seven days of travel. (
(3) Special Conditions: If a guest desires a secure no-cost cancellation option until the day of arrival, this may be arranged by paying a special fee. For this purpose Terminal Apartments must be informed directly after booking! Otherwise, no other cancellation policy than listed above is possible.
(4) Cancellations on the part of the Host (Terminal Apartments) are permitted.
(4.1) Terminal Apartments as landlord can make use of its domiciliary right and refuse or cancel a booking. The Guest shall have no right of cancellation.
(4.2) In case of cancellation on the part of the Host, as a result of force majeure (e.g. burst pipe) or other unforeseeable circumstances, as well as other circumstances for which the Host is not responsible and which make it impossible to fulfill the contract, Terminal Apartments must refund the full booking price or, in the case of an ongoing trip, on a pro rata basis. There shall be no claim for damages.
§ 9 Liability of the Lessor The liability of Terminal Apartments towards the guest is - as far as legally permissible - excluded. In particular, Terminal Apartments shall not be liable for any damage caused by the guest to the host or vice versa. Data communication via the Internet cannot be guaranteed to be error-free and/or available at all times according to the current state of technology. Therefore, the Host does not guarantee the constant and uninterrupted availability of its Internet portal and shall not be liable for failures due to technical and electronic errors over which the Host has no control.
§10 Events and parties
Parties or events are not permitted.
§ 11 Smoking
Smoking is not allowed in the accommodation and in the hallway. In case of violation, the accommodation reserves the right to charge a cleaning fee of 150€.
§ 12 Noise
Between 10 p.m. and 6 a.m. the legal night rest applies. During this time, please keep the volume at room volume.
§ 13 Severability clause
Should one or more provisions of these General Terms and Conditions become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose pursued by the invalid provision.
§ 14 Acceptance of the General Terms and Conditions
The Lessee agrees to the General Terms and Conditions as well as the house rules of the Lessor Terminal Apartments, represented by Nadja Remann. No written declaration of consent is necessary, the GTC are accepted with successful booking. In case of violations of the GTC or the house rules, the landlord is entitled to terminate the rental relationship immediately and without notice. A legal claim for repayment of the rental amount or compensation does not exist.
